2024 EEO-1 Filing Dates

  • Private sector employers with 100 or more employees and federal contractors with 50 or more employees meeting certain criteria are required to file. 
  • The EEOC will not collect EEO-1 component 2 pay data reports. 

Important 2024 EEO-1 Reporting Information

The U.S. Equal Employment Opportunity Commission (EEOC) will accept the 2024 EEO-1 Component 1 data collection report from employers beginning May 20, 2025. The deadline to submit the EEO-1 Component 1 data reports is June 24, 2025.

Employers should note the following:

  • However, the agency won't deliver a “Notice of Failure to File” letter, as they have in prior years, nor will it grant additional time to file.
  • Furthermore, the agency has yet to update the EEO-1 Component report to reflect the additional race/ethnicity category, “Middle Eastern or North African.”
  • The agency has also eliminated the optional reporting of non-binary employee data in the comments section.

Private Employers

All private-sector employers subject to Title VII with 100 or more employees during an employer-selected pay period in the fourth quarter of the reporting year must submit and certify an annual EEO-1 Component 1 report containing required workforce demographic information.

A private employer subject to Title VII with fewer than 100 employees must file and certify an EEO-1 Component 1 report if the employer owns, is owned by, and/or is affiliated or associated with another employer or there is a centralized or common ownership, control, or management so that the group of employers constitutes a single enterprise and/or integrated enterprise and the entire enterprise has 100 or more employees during an employer selected pay period during the snapshot period. 

Beginning with the 2023 EEO-1 Component 1 data collection, an employer who meets the employee threshold for EEO-1 component 1 reporting purposes at any time during the snapshot period may not select a workforce snapshot period that falls below the threshold to avoid the filing requirement.

Federal Contractors

For 2024, a federal prime contractor or subcontractor that meets all the following criteria has a mandatory legal obligation to submit and certify annual EEO-1 Component 1 reports containing required workforce demographic data:

  • Is not exempt from Office of Federal Contract Compliance Programs (OFCCP) Section 60-1.5 regulations
  • Has 50 or more employees
  • Is a prime contractor or first-tier subcontractor
  • Has a contract, subcontract, or purchase order amounting to $50,000 or more or serves as a depository of government funds in any amount, or is a financial institution that is an issuing and paying agent for U.S. savings bonds and savings notes: 
    • Any subcontractor below the first tier who performs construction work at the site of construction shall be required to file such a report if it meets requirements (1), (2), and (4).

Filers should begin preparing to submit data in anticipation of the collection period's start date. EEO-1 Component 1 filers can access agency resources, including the EEO-1 Component 1 Instruction Booklet by visiting the EEO-1 Website.

Filing Process

Covered employers are required to provide data about their workforce, including race, ethnicity, sex, and job category. This information should be collected from a “snapshot period” or payroll period in the 4th quarter of 2024.

The preferred method of collecting employee data is through voluntary self-identification. If, however, an employee chooses not to answer, an employer can make a selection through observer identification or reviewed employment records. The EEO-1 only provides binary options (i.e., male and female) for reporting employee counts by sex, job category, and race or ethnicity. As of 2024, employers are no longer able to voluntarily report demographic data for non-binary employees in the comments section of the report.

The preferred and most efficient method to submit EEO-1 Component 1 Reports is through the EEO-1 Component 1 Online Filing System or as an electronically transmitted data file (TXT or CSV) via a data file upload.
