Summary

Colorado's Family and Medical Leave Insurance (FAMLI) program offers paid leave benefits for medical, family, and caregiving needs, funded through employer and employee contributions. As part of this program, employers must annually update their total employee headcount to determine the correct premium rates for the following year. Employers must submit 2025 updates to the agency by February 28, 2025. 

Calculating Headcount and Impact on Rates

Employers should include all employees, both in Colorado and out-of-state, when calculating the annual headcount of their total nationwide workforce. If the resulting headcount is more than 10 employees, the employer is liable to remit 0.9% of subject wages to the FAMLI program each quarter. If the headcount is below 10, the employer is liable to remit 0.45% of the subject wages to the program each quarter. If employers don't update their annual total employee headcount by February 28, 2025, the FAMLI Division will assume the employer has 10 or more employees, resulting in a higher premium rate for 2025.

Next Steps

Employers must submit this information directly through their My FAMLI+ Employer dashboard by February 28, 2025. Paylocity is unable to submit the update on the employer's behalf.
